1. Acceptance of Terms

By downloading, installing, or using Mystic Journal ("the App"), operated by Nick Adlem trading as Mystic Journal ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download or use the App.

You must be at least 13 years of age to use the App. By using the App, you represent that you are at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you must have a parent or guardian review and consent to these Terms on your behalf.

2. Description of Service

Mystic Journal is a spiritual practice, reflection, journaling, educational and entertainment/wellbeing companion that may include features such as:

Mystic Journal is intended for personal reflection, exploration, education and entertainment. It does not predict the future, provide psychic certainty, diagnose conditions or provide professional medical treatment. It is not a substitute for professional medical, psychological, legal, or financial advice.

3. Spiritual and Divination Disclaimer

Tarot, runes, astrology, numerology, crystal meanings, spiritual interpretations and any AI-assisted spiritual guidance are provided for personal reflection, exploration, education and entertainment.

They are not guaranteed predictions, are not statements of factual certainty, and are not a substitute for your own judgement or for professional advice. You remain responsible for any decisions you make based on information presented in the App.

4. Health and Wellness Disclaimer

Crystals, herbs, meditation, rituals and related wellness and spiritual content in Mystic Journal are educational and reflective in nature.

They are not medical advice and are not intended to diagnose, treat, cure or prevent any disease or health condition. If you have medical or health concerns, you should seek advice from an appropriately qualified professional.

5. Your Data and Privacy

Mystic Journal does not require you to create an account. All your journal entries, habit data, birth chart information, and personal settings are stored locally on your device. By using the App, you acknowledge that:

You may delete all your local data at any time through Profile Settings, then Data Management, then Delete All Data. This permanently removes your journal entries, habits, achievements, settings, and all associated content from your device. Some anonymized data may be retained for legal compliance purposes as required by law.

Premium features require a paid subscription (Mystic Journal Premium), offered as monthly and annual auto-renewing subscription options. By purchasing a subscription, you agree to the following:

The App uses artificial intelligence to provide spiritual guidance, tarot interpretations, and personalized recommendations. By using these features, you acknowledge that:

8. Crystal Scanner and AI Identification

The Crystal Scanner feature allows you to identify crystals from photographs. When you choose to use Crystal Scanner, the photograph or photographs you select are transmitted securely to an external AI service for analysis and identification, together with any observations you choose to provide.

The resulting identification is an AI-generated estimate and may be incomplete or incorrect. Crystal Scanner results should not be relied upon where professional mineral identification, valuation, authenticity testing or safety determination is required. Crystal Scanner photographs remain saved on your device and are not shared publicly or used by Mystic Journal for advertising. See our Privacy Policy for full details.

Mystic Journal, including its original text, illustrations, artwork, graphics, interface designs, databases, course materials, reference content and other original content, is protected by applicable copyright and intellectual property laws.

Except where expressly permitted by these Terms or applicable law, Mystic Journal content may not be copied, reproduced, republished, distributed, modified, sold or commercially exploited without prior written permission from the copyright owner.

Certain third-party materials, technologies, trademarks and other content remain the property of their respective owners and are used subject to applicable licences, permissions and terms.

10. User-Generated Content

You retain full ownership of the journal entries, photographs, notes and other original content you create or store in the App. We do not claim ownership of your content.

Content you create in the App — for example journal entries, saved photographs or scan notes — is stored locally on your device and is used only to provide the features you have chosen.

You are solely responsible for content you create and store in the App. You must not store or submit content that is unlawful, threatening, abusive, harassing, hateful, sexually explicit or sexually exploitative, infringing of others' rights, fraudulent, or otherwise prohibited.

We may moderate, remove or restrict content where necessary to enforce these Terms and protect users. See also the Prohibited Uses section below.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICK ADLEM, TRADING AS MYSTIC JOURNAL, EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

We may suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

You may stop using the App and delete your data at any time through Profile Settings. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive termination.

The App may contain links to third-party websites or services, including The Old Broomstick marketplace. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party services is at your own risk and subject to their respective terms and policies.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

21. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith informal negotiations. If the dispute cannot be resolved informally within 30 days, either party may submit the dispute to binding arbitration under the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, England, and shall be conducted in English.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.
